Terms of Service

Product: LeadScout (UK-only, B2B)

These Terms of Service (“Terms”) govern your access to and use of LeadScout (the “Service”). By creating an account or using the Service, you agree to these Terms.

1. Who we are

The Service is provided by Naitiv Technologies Limited (“we”, “us”, “our”).

2. Who can use LeadScout

LeadScout is a business-to-business product intended for business users in the United Kingdom. By using the Service, you confirm that:

  • you are using it for business purposes; and
  • you have authority to enter into these Terms on behalf of a business (where applicable).

The Service is not intended for children.

3. Your account

You are responsible for:

  • keeping your login details secure;
  • any activity under your account; and
  • ensuring the information you provide is accurate and up to date.

We may suspend or terminate accounts to protect the Service or other users, including in cases of suspected misuse, unlawful activity, or breach of these Terms.

4. The Service and early access

LeadScout is provided on an early access basis. This means:

  • features may change, be added, removed, or discontinued;
  • results may not be complete, accurate, or available at all times; and
  • we may limit access, rate-limit usage, or restrict certain functionality.

We aim to keep the Service available, but we do not guarantee uninterrupted operation.

5. What LeadScout does (and doesn't)

LeadScout scans UK planning applications and generates a shortlist of opportunities that may be relevant to your trade and service area. It may also display business contact information in a B2B context and provide suggested outreach email drafts.

Important: LeadScout provides information and productivity tools only. It is not legal, planning, financial, or professional advice. You are responsible for:

  • verifying project details;
  • deciding whether and how to contact any party; and
  • ensuring your outreach and business activities comply with applicable laws and industry standards.

6. Acceptable use

You agree not to:

  • use the Service for any unlawful, harmful, or misleading purpose;
  • attempt to access or probe systems or data you are not authorised to access;
  • interfere with or disrupt the Service (including scraping, automated extraction, or excessive requests unless explicitly permitted);
  • reverse engineer the Service (except to the extent permitted by law);
  • upload or transmit malware or harmful code;
  • use the Service to spam, harass, or send unsolicited communications in breach of applicable laws.

We may investigate suspected misuse and take action, including suspension or termination.

7. Contact data and restrictions

LeadScout may present business contact information that we believe is relevant to the commercial context of a planning application.

To protect data subjects and the integrity of the Service:

  • contact information is provided view-only;
  • you must not attempt to bulk extract contact details or compile databases from the Service; and
  • you must use any contact information responsibly and in compliance with applicable laws (including UK GDPR and PECR where relevant).

If you believe any data shown in the Service is incorrect or inappropriate, contact us at contact@wearenaitiv.com and we will investigate.

8. AI-generated outputs

Some parts of the Service may generate summaries, match explanations, or draft outreach emails. These outputs may be incorrect or incomplete. You are responsible for reviewing and editing any AI-generated content before using it.

9. Intellectual property

We own (or license) all intellectual property rights in the Service, including its software, design, and content (excluding content you provide).

You are granted a limited, non-exclusive, non-transferable right to use the Service for your internal business purposes, in accordance with these Terms.

You must not copy, modify, distribute, sell, or lease any part of the Service unless we expressly agree in writing.

10. Feedback

If you provide feedback, suggestions, or ideas, you agree we can use them to improve the Service without obligation to you (including without compensation), and you grant us a perpetual, worldwide, royalty-free licence to do so.

11. Suspension and termination

You may stop using the Service at any time. You can delete your account using the in-app deletion option or by contacting contact@wearenaitiv.com.

We may suspend or terminate your access:

  • if you breach these Terms;
  • if we reasonably believe your use poses a security, legal, or operational risk; or
  • if we decide to discontinue the Service.

12. Disclaimers

To the fullest extent permitted by law:

  • the Service is provided “as is” and “as available”;
  • we do not warrant that the Service will be uninterrupted, error-free, or that results will be complete or accurate; and
  • we are not responsible for decisions you make or actions you take based on information from the Service.

13. Liability

Nothing in these Terms limits or excludes liability where it would be unlawful to do so (including for death or personal injury caused by negligence, or fraud).

Subject to the above, we will not be liable for:

  • indirect, incidental, special, consequential, or punitive losses;
  • loss of profits, revenue, business, goodwill, data, or opportunity; or
  • losses arising from your use of, or inability to use, the Service.

Our total liability for all claims relating to the Service will not exceed £100 (or, if you have paid us for the Service in the past 12 months, the amount you paid us in that period), whichever is higher.

14. Changes to these Terms

We may update these Terms from time to time. If changes are material, we will post the updated Terms and update the effective date. Continued use of the Service after changes take effect means you accept the updated Terms.

15. Governing law

These Terms are governed by the laws of England and Wales, and the courts of England and Wales shall have exclusive jurisdiction, except where mandatory consumer protections apply (noting this is a B2B service).
